Terms of Use

1. Introduction

Welcome to the Loot Scan application and any other products or services owned or operated by Loot Scan (“Company” or “we” or “us” or “our”) (collectively, the “Service”). To access the Service, you must at all times agree to and abide by these terms of use, including any additional guidelines, and any future modifications (collectively, these “Terms”). These Terms are a legal contract between you, a user of at least 18 years of age (“you” or “User”), and the Company regarding your use of the Services.

By accessing, installing, browsing, using or subscribing to, or registering for the Service (including any content created, uploaded, downloaded, copied, published, and propagated during the use of the Service), you acknowledge that you have read, understood, and agree to be bound by these Terms. If at any time you do not agree to these Terms, please terminate your use of the Service.

Although the Service is always striving to improve itself, it is not perfect. The Service utilizes Artificial Intelligence ("AI") to provide approximate market value estimates. The information provided is not a professional insight. While we make reasonable efforts to ensure the information provided is accurate, we cannot ensure the accuracy, completeness and reliability of any and all information, data or content on the Service. Therefore, You agree and understand that during Your use of the Service, no content feedback can be used as any basis for any civil or commercial activities performed by You and/or others, otherwise all risks that may arise from such activities and all responsibilities shall be borne by you, not by the Company.

2. Authorized Users

Your access to and use of the Service is subject to all applicable international, national, federal, state and local laws and regulations. You represent and warrant that you will not use the Service in any manner or for any purposes that are unlawful or prohibited by these Terms. The Service is not for persons under the age of 18. If you are under 18 years of age, then please do not use the Service.

3. Specific Features and Services

When using the Service, you may be subject to additional posted guidelines or terms and conditions applicable to specific services and features which may be posted from time to time (the “Guidelines”). All such Guidelines are hereby incorporated by reference into the Terms. In addition, your use of the Service is governed by our privacy policy, and you consent to the collection, use and disclosure of any personal information provided by you to use in accordance with the Privacy Policy.

4. Changes

The Company may revise these Terms from time to time. Although we may include a notice on the home page of the Service that the Terms has been modified, such notice may not remain in place for any extended period of time. Accordingly, you should review the Terms as posted on the Service from time to time. Using the Service after any revised Terms has been posted will constitute your acceptance of the revised Terms.

5. Limited License

Subject to the terms and conditions of these Terms, the Company hereby grants you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to use the Services (and all updates or upgrades provided) solely for private, non-commercial purposes in accordance with these Terms.

6. Ownership; Proprietary Rights

The Service is owned and operated by the Company. The content, visual interfaces, information, graphics, design, compilation, computer code, products, software, algorithms, services, and all other elements of the Service that are provided by the Company are protected by copyright, trade dress, patent, and trademark laws. All Materials contained on the Service are the copyrighted property of the Company or affiliated companies and/or third party licensors. Except as expressly authorized by the Company, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, decompile, disassemble, reverse engineer, create derivative works from, or otherwise make unauthorized use of the Materials.

7. Restrictions

As a condition of your use of the Service, you will not use the Service for any purpose that is unlawful or prohibited by these Terms. You will not use the Service in any manner that could damage, disable, overburden, or impair it or interfere with any other party’s use. You will not attempt to gain unauthorized access to the Service, or any part of it, through hacking, password mining or any other means.

8. Your Content

Prohibited Content. You shall not use the Service to create, upload, download, copy, publish or propagate any images, sounds, videos, data, text, information or any other materials or content that violates any rule, law, regulation or policy; harms national interests; incites ethnic or racial discrimination; undermining social stability; or contains obscenity, violence, or defamation.

License to Your Content. You hereby grant the Company a worldwide, non-exclusive, irrevocable, royalty-free, fully-paid, perpetual, sublicensable license to use, reproduce, and display any Content that you upload. We can use Your Content in the Application and in our other products or services.

9. Representation and Warranty

You represent, warrant and covenant that at all times: (i) the Your Content does not infringe any third party’s intellectual property, right of reputation, right of name, right of privacy, or moral rights; (ii) you own or have the necessary licenses, rights, consents and permissions for your use of Your Content.

10. Identity Authentication

The Company uses many techniques to identify you when you register. This verification is only an indication of increased likelihood that your identity is correct. To prevent system abuse, the "Welcome Bonus" (3 free credits) is restricted to one (1) claim per unique hardware device. You authorize the Company to make any inquiries considered necessary to validate your registration and enforce this hardware limit.

11. Photo Credits & Subscriptions

Users may purchase Photo Credits or subscribe to recurring plans. Weekly Refill: All active subscription plans include a recurring refill of 100 Photo Credits every seven (7) days. No Cash Value: Photo Credits are a limited license to use Service features. They have no monetary value, are non-transferable, and are non-refundable except as required by law or platform (Apple/Google) rules.

12. User Account Information

You agree that the information you provide to the Company upon registration and, at all other times, will be true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your device.

13. Communications; Notice

You consent to receive communications from the Company electronically. We will communicate with you by email or by posting notices on the Service. Legal notices shall be deemed given 24 hours after email is sent.

14. Feedback

Any suggestions, comments, or ideas provided to the Company related to the Services (“Feedback”) shall not be considered your confidential information and may be used by the Company for any purpose without compensation.

15. Third Party Sites

The Service may include links to other websites or services solely as a convenience to users. The Company does not endorse any Linked Sites or the information contained on them. Use of linked sites is solely at your own risk.

16. Discontinuance of Service

The Company may make changes to or discontinue any of the content or services available on the Service at any time, and without notice.

17. User Content Disclaimer

You acknowledge and agree that: (a) Content is provided to you AS IS; (b) the Company does not guarantee accuracy of User Content; (c) you may encounter User Content that you deem offensive; and (d) the Company has no liability for such User Content.

18. Termination

The Company, in its sole discretion and for any reason, may terminate any account you may have. We reserve the right to discontinue any aspect of the Service at any time without prior notice.

19. Disclaimers; No Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE. YOU ACKNOWLEDGE THAT THE SERVICE MAY BE SUBJECT TO OPERATING ERRORS OR SYSTEM DOWN TIME.

20. Indemnification

You agree to indemnify and hold the Company, its affiliates, and partners, harmless from any claims, losses, or damages arising out of your use or misuse of the Service or violation of these Terms.

21. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS ($100.00).

22. Disputes and Arbitration

Any dispute, controversy or claim arising shall be referred to and finally resolved by binding arbitration. The seat of the arbitration shall be New York, New York, U.S.A. By using the Service, you agree that the statutes and laws of the United States and the State of New York will apply.

23. Miscellaneous

A provision of these Terms may be waived only in writing. If any provision is found unlawful or void, that provision shall be deemed severable. These Terms are the entire agreement between you and the Company.

24. Cause of Action

YOU AND THE COMPANY AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

25. Apple App Store Notice

These Terms are between you and the Company only, not with Apple. Apple is not responsible for the Service. Apple has no obligation to furnish maintenance or support. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms.

26. Financial and Income Disclaimer

The Service may include educational materials, case studies, or "blueprints" (collectively, "Educational Content") regarding the resale market. You acknowledge and agree that: (a) Educational Content is provided for informational purposes only; (b) the Company does not guarantee that you will achieve any specific financial result or earn any money by following the techniques described; (c) your success depends on your own efforts, market conditions, and the items you source; and (d) the Company is not responsible for any financial losses you may incur. The Service is a tool, not a financial investment or a guaranteed income opportunity.
